Terms of Use

1. Introductory provisions

These Terms of Use (the "Terms") govern the use of the website and services of the Eloee platform operated by ELOEE s.r.o., with its registered seat at č.p. 147, 252 05 Hvozdnice, Czech Republic, Company ID (IČO) 195 92 957, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 388927 (the "Operator"). 2. Definition of the service

The Eloee platform provides business entities (manufacturers, importers, and sellers) with tools to fulfil obligations arising from Directive (EU) 2024/1799 of the European Parliament and of the Council on common rules promoting the repair of goods and from the national legislation implementing it, in particular: receiving and managing repair requests, generating the European Repair Information Form (ERIF), tracking repair status, and archiving documentation for the purpose of demonstrating compliance.

3. Nature of the service and responsibility for fulfilling legal obligations

The Operator provides technical tools that facilitate the fulfilment of the client's legal obligations. Responsibility for the legal obligations arising from the relevant legislation remains with the client. The service does not constitute legal advice.

4. Use of the website

The user undertakes to use the website and services in accordance with applicable law and these Terms, to provide truthful and complete information, and not to interfere with the technical operation of the platform.

5. Conclusion of the service agreement

An agreement for the provision of the paid service is concluded individually on the basis of the client's order and its confirmation by the Operator. Service prices are stated on the Operator's website; the Operator reserves the right to change the price offer, while the price agreed at the time of conclusion applies to agreements already concluded.

6. Intellectual property

The content of the website and platform, including text, graphics, software, and design, is protected by the intellectual property rights of the Operator or third parties. Use beyond ordinary browsing requires the Operator's prior consent.

7. Protection of personal data

Information on the processing of personal data is set out in a separate Privacy Policy document available on the Operator's website.

8. Out-of-court resolution of consumer disputes

If the user is a consumer, the entity for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce), Gorazdova 1969/24, 120 00 Praha 2, www.coi.cz.

9. Governing law

Legal relationships arising in connection with the use of the website and services are governed by the law of the Czech Republic.

10. Changes to the Terms

The Operator is entitled to amend these Terms. The new wording takes effect on the date of publication on the website, unless the Operator sets a later date. For agreements already concluded, the provisions on changes contained in the agreement apply.

11. Final provisions

If any provision of the Terms is invalid or ineffective, the validity of the remaining provisions is not affected. These Terms take effect on the date of their publication on the Operator's website.
